Business Setup in Makkah: Company Formation in the Holy City

Makkah's private economy is organized around pilgrims: hotels, food, transport, retail and the contractors who build and maintain them. A foreign investor forms a company here through the same MISA license and Commercial Registration as anywhere in the Kingdom, typically in 4–12 weeks end to end. What is different in Makkah is who may enter the city, what non-Saudis may own there, and which pilgrim-facing activities need a separate license.

How to set up a company in Makkah, step by step

The legal sequence is the national one. In Makkah, three questions come before any filing: whether your activity is open to foreign investors, who will run the business inside the city, and which sector license you need after the CR.

  1. 01

Check the activity against the restricted list

Most service and trading activities are open to foreign ownership under a MISA license. Services connected to Hajj and Umrah are among the short list of activities that are closed or restricted for foreign investors. For a pilgrim-facing business, this check decides whether the structure works at all, so it comes first.

  2. 02

Decide who will work inside the city

Non-Muslims may not enter Makkah. If a shareholder, the general manager or key staff are not Muslim, settle early who will run the premises, supervise staff and meet customers on the ground. This shapes the management structure and the visa plan, not just travel.

  3. 03

Attest documents and obtain the MISA license

A foreign corporate shareholder's commercial registration and articles are legalized and translated into Arabic, then the MISA application is filed online. A complete file is typically approved within 2–6 weeks. The license sets your permitted activities and renews annually.

  4. 04

Register the company with the Ministry of Commerce

The trade name, Articles of Association and Commercial Registration are completed through the Saudi Business Center, with your Makkah address as the registered address. From MISA license to CR is typically 1–2 weeks when documents are in order.

Add the sector license for your activity

A hotel or serviced apartment building needs a Ministry of Tourism license. Services to pilgrims are licensed by the Ministry of Hajj and Umrah. Restaurants, cafés and shops need the municipality license for their premises.

Register on the government platforms and open the bank account

ZATCA, GOSI, Qiwa, Mudad and Muqeem registrations are what let you hire, sponsor visas and invoice. The bank account typically takes 2–4 weeks and needs the CR, the MISA license and the general manager's iqama or an in-person visit.

What drives Makkah's economy

Hajj fills the city once a year and Umrah brings visitors in every month. Vision 2030's Pilgrim Experience Program aims to bring 30 million Umrah performers and visitors to the Two Holy Mosques by 2030, and hotels, food, transport and retail all scale with that flow.

The register reflects it. Relative to its size, Makkah has far more hotels, travel agencies, passenger transport operators and catering businesses than the national average, and hotels appear among its largest activities in the panel below. Construction and fit-out contractors are still the biggest groups by count, as in most Saudi cities. Most registrations in Makkah are sole proprietorships rather than companies.

It is also a growing place to register. Makkah recorded more new registrations in 2025 than in any earlier year in the register. Development in the city is overseen by the Royal Commission for Makkah City and Holy Sites, whose programs range from neighborhood redevelopment to public transport.

Access rules that shape a Makkah business

Non-Muslims may not enter Makkah, and the ban is enforced. MISA's published registration requirements are the same for every city, but a founder or manager who is not Muslim cannot visit premises, meet customers or supervise staff in Makkah. Anyone whose job is on site must be able to enter the city, so this affects hiring as well as visits.

Access also tightens every year before Hajj. In 2026, the Ministry of Interior required residents to hold a permit to enter Makkah from 25 Shawwal, unless they had a Makkah-issued residency, a Hajj permit or a work permit for the holy sites. From 1 Dhu al-Qi'dah, holders of all visa types other than Hajj visas could not enter or remain in the city. Seasonal work permits are issued through Absher and the Muqeem portal.

Staff who live in Jeddah, suppliers' drivers and visiting executives all need planning for those weeks, so schedule fit-out and hiring outside them. One option is to keep management and back office in Jeddah, which the Haramain High Speed Railway links to Makkah, and run only the customer-facing premises inside the city.

Property and premises in Makkah

Real estate ownership inside Makkah has long been closed to foreign investors. The law on real estate ownership by non-Saudis, in force since 22 January 2026, opens it only in part. The Real Estate General Authority (REGA) states that ownership in Makkah and Madinah is restricted to Muslim individuals and to Saudi companies with non-Saudi shareholders, and only within specific geographic areas set by the implementing regulation and the geographic scope document.

Forming a company does not require owning property. The rule matters if your plan depends on owning a hotel, a building or land, or on holding long-term rights over one. Treat that as a separate legal question, check the current zones on REGA's Saudi Properties portal, and confirm how your premises will be held before you sign anything.

The licenses that come after the CR

A Commercial Registration makes the company exist. In Makkah's main sectors it is rarely the last license you need, and the sector license usually sets the opening date.

  • The Ministry of Hajj and Umrah consulted publicly in November 2025 on new licensing requirements for providers serving Umrah performers and visitors to the Prophet's Mosque from outside the Kingdom. Plan against the final rules, not earlier versions.
  • Every hospitality facility, including private establishments, must hold a valid Ministry of Tourism license to operate, and booking platforms have been told to remove unlicensed listings.

How Alpha handles a Makkah incorporation

Alpha is based in Jeddah, at Salama Tower in Al Salamah District. We do not have an office in Makkah, and formation does not need one. With your authorization, we file the MISA license, the Commercial Registration and the ZATCA, GOSI and Qiwa registrations on the government's online platforms, which work the same way for a company registered in any Saudi city.

We raise the Makkah-specific questions at the start: the activity check, who will work inside the city, and how premises will be held. We work in Arabic, English, Hindi, Urdu and French, by phone, WhatsApp or email, Sunday to Thursday, 9:00 to 18:00.

Frequently asked questions

Can a foreigner open a company in Makkah?
Yes, in activities open to foreign investment. A foreign investor obtains a MISA license and then a Commercial Registration, the same route as in any Saudi city, and can own up to 100% in most activities. Services connected to Hajj and Umrah are restricted for foreign investors, so the activity check comes first.
Can non-Muslims do business in Makkah?
Non-Muslims may not enter Makkah, so a non-Muslim founder or manager cannot visit premises or work in the city. MISA's published registration requirements are the same for every city, but the business needs people on the ground who can enter Makkah. Raise this before filing, because it shapes who runs the company and where management sits.
Can a foreign company own property in Makkah?
Not directly. REGA states that ownership in Makkah is restricted to Muslim individuals and to Saudi companies with non-Saudi shareholders, and only within designated areas under the non-Saudi real estate ownership law in force since January 2026. Forming a company does not require owning property, but check the zones before any plan that does.
How long does company formation take in Makkah?
The MISA license typically takes 2–6 weeks from a complete application, and the full sequence through to the bank account typically takes 4–12 weeks, plus any sector license. Avoid the weeks before Hajj for anything that needs people inside the city, because entry is restricted then.
How much does it cost to set up a company in Makkah?
Formation fees are set nationally. The first-year total depends on the activity, the shareholder type and the MISA subscription, and trading, regulated activities and sector licenses cost more. Use the cost calculator for a line-by-line figure.
Do I need a license from the Ministry of Hajj and Umrah?
Only if you provide services it licenses, such as services to Umrah performers coming from abroad. These activities are restricted for foreign investors, and the ministry consulted on new licensing requirements in late 2025. Hotels are licensed by the Ministry of Tourism instead.
Should I register my company in Makkah or Jeddah?
Register where the business operates. If your premises, staff and customers are in Makkah, register there. If Makkah is one market among several, or your management cannot enter the city, a Jeddah company serving Makkah is often simpler, and it can add a branch registration in Makkah later.
What are the biggest business sectors in Makkah?
Contracting and fit-out are the largest groups by count, as in most Saudi cities. What sets Makkah apart is hospitality and pilgrim services: relative to its size, it has far more hotels, travel agencies, passenger transport and catering businesses than the national average. The register panel on this page shows current figures.
Can Alpha register my company in Makkah if your office is in Jeddah?
Yes. The MISA, Ministry of Commerce, ZATCA, GOSI and Qiwa steps are filed online, on your behalf and with your authorization, and work the same for a company registered in any Saudi city. Your company is registered at its Makkah address.
